Automotive Replacement Glass Division – Web Portal Privacy Policy
This Privacy Policy relates to the use of our Web Portal www.agc-arg.com and sets out:
- the conditions under which the Automotive Replacement Glass (“ARG”) Division of AGC AUTOMOTIVE EUROPE SA, a company incorporated under Belgian law, with registered office located in Belgium, 1348 Louvain-la-Neuve, Avenue Jean Monnet 4, and registered with the Crossroads Bank of Enterprises under number 0442.444.219 (“AGC AUTOMOTIVE EUROPE”), as data controller, processes your Personal Data in the framework of the sale and supply of AGC and NordGlass products; and
- your rights and our obligations in relation to such processing.
For the purpose of this Privacy Policy, the Web Portal also refers to its related mobile application.
“Personal Data” refers to any information that relates to you as user of the Web Portal.
You are invited to carefully read and, where required, consent to this Privacy Policy as you are requesting access on behalf of your company to the dedicated pages of the Web Portal for the first time. The Web Portal will not be accessible until you have confirmed that you have read and, where required, agreed to this Privacy Policy.

Any future change to this Privacy Policy will be notified to you (through a pop-up or otherwise) when logging into the dedicated pages of the Web Portal. The Web Portal will not be accessible until you have confirmed that you have read these changes and, where required, accepted them.
When being granted a user ID and a password to access the dedicated pages of the Web Portal and using them, you acknowledge that (i) you must keep the user ID and password confidential, not share it with anyone (also not with colleagues) and use it solely for the purpose of accessing the Web Portal in accordance with your company’s instructions and (ii) you have been informed of the processing and transfer of the Personal Data you communicate via the Web Portal to AGC AUTOMOTIVE EUROPE for the purposes described below. If you provide Personal Data about other employees and agents of your company, you shall inform your company in advance about the processing of their Personal Data by AGC AUTOMOTIVE EUROPE so as to enable your company to inform them of the content of this Privacy Policy to which your company may request access and, where required, obtain their consent.
Until 24 May 2018, the processing of Personal Data by AGC AUTOMOTIVE EUROPE is subject to the Belgian Law of 8 December 1992 on the protection of privacy with regard to the processing of personal data (as modified by the law of 11 December 1998 transposing Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data), it being understood however that, where the processing of Personal Data also takes place in the context of the activities of an establishment of an AGC company acting as data controller in an EU Member State other than Belgium, the national law of that EU Member State transposing Directive 95/46/EC shall apply. As from 25 May 2018, the processing of Personal Data will be subject to the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”).
- Which information does AGC AUTOMOTIVE EUROPE collect?
AGC AUTOMOTIVE EUROPE, as data controller, may collect the following information from you or the company (of which you are a representative) based on legitimate legal grounds such as the necessity for the performance of the sale and supply of AGC and NordGlass products or, depending of the circumstances of the case, its legitimate interest (including to provide a secured access to the Web Portal) or, as may be legally required, your consent:

• name and surname;
• title/function;
• contact information, including professional phone number, email and address;
• all information regarding the pages visited by you on the Web Portal of AGC AUTOMOTIVE EUROPE, such information being only collected in anonymized form and subject to your right to object to such data processing (“opt-out”);
• login details;
• other information collected through social media websites, loyalty schemes or contests we organize; and
• other information relevant to any survey that we may run in relation to your use of the Web Portal.
Providing your Personal Data to AGC AUTOMOTIVE EUROPE is voluntary, but required to use our Web Portal.
- What does AGC AUTOMOTIVE EUROPE do with this information?
AGC AUTOMOTIVE EUROPE requires this information (including Personal Data) to provide its clients with the services related to the use of the Web Portal (i.e. the sale and supply of AGC and NordGlass products), understand the user’s needs and provide him/her with a better service, and in particular for the following purposes:
- for user management (such as account management and answering questions)
- to improve services (including drawing up statistics)
- to periodically send promotional email about new products, special offers and information which you or your company may find interesting using the email address which you have provided
- from time to time, to contact you for market research purposes.
Please note that any objection by you to the processing of your Personal Data for the purposes under c) and d) above will not affect your capability to use the Web Portal.
AGC AUTOMOTIVE EUROPE only processes your Personal Data for internal purposes and does not share it with third parties, except, in compliance with applicable law, (i) with service providers for the purpose of conducting customer surveys, (ii) with IT consultants for the management of the Web Portal , (iii) with transport companies for the purpose of organising the transport of products of AGC AUTOMOTIVE EUROPE and (iv) with public authorities when legally required to do so. In the cases (i) to (iii) above, the third parties having access to your Personal Data are acting as data processors. The identity of those acting as data processors on behalf of AGC AUTOMOTIVE EUROPE will be disclosed to you upon request.

Your Personal Data may be transferred to a jurisdiction outside the European Economic Area (i.e. the EU Member States plus Iceland, Liechtenstein and Norway or “EEA”) and Switzerland, in which case AGC will take appropriate measures to ensure such transfer is carried out in compliance with the applicable data protection rules.
[For Germany: ***Covered by your explicit consent*** ] Subject to your explicit consent, which you may provide by ticking the appropriate box upon your first login onto the Web Portal, AGC AUTOMOTIVE EUROPE may send you direct marketing e-mails about new products, special offers and information which you or your company may find interesting, using the e-mail address you have provided. You may also consent to receive direct marketing emails from third parties, including the entities of our group.
Taking into account the state of the art of the technology, the costs of its implementation, the nature of the data and the risk of the processing, AGC AUTOMOTIVE EUROPE shall implement appropriate technical and organisational measures to ensure a level of security and confidentiality of the Web Portal (and the related part of our systems) so as to protect your Personal Data against accidental or unlawful destruction or alteration, accidental loss, unauthorized disclosure or access and against other unlawful forms of processing.
To ensure that the Personal Data we collect and process about you remains up to date and accurate, AGC AUTOMOTIVE EUROPE may request you to confirm the Personal Data it holds about you. Absent any response within a reasonable time, your user ID will be considered obsolete and your Personal Data will be deleted from our system unless it must be kept for legal or contractual or other any legitimate reasons (for example, to evidence a transaction on the Web Portal).
Unless otherwise legally required, your Personal Data will be stored for a period not exceeding 12 months after you stop actively ordering products online (through the Web Portal) and offline.
- Use of cookies
A cookie is a text file which may be placed on the computer of the user when visiting the Web Portal. It contains information that is collected from such computer and sent back to the Web Portal on each subsequent visit so as to remember actions and preferences of the user over time.
AGC AUTOMOTIVE EUROPE uses only cookies to identify and memorise your country and language preferences upon your first access to our Web Portal as well as your user ID and password upon login to our Web Portal (both being technical cookies) and to identify and record which pages of the Web Portal you access (via third party analytics cookies). We confirm that we will only collect your Personal Data in anonymized form using the above cookies and grant you the right to object to such data processing for analytics cookies. These cookies help AGC AUTOMOTIVE EUROPE to improve the browsing experience on the Web Portal and tailor it to users’ and clients’ needs. AGC AUTOMOTIVE EUROPE also uses this information for statistical analysis. Unless otherwise legally required, the data will remain on the system for maximum 12 months from the last use of the Web Portal by a given user and will be removed from the system thereafter. Data generated by analytical cookies may be transferred to our US service provider which has adhered to the EU-US Privacy Shield.
In addition, you may block, delete or disable cookies by activating the relevant settings on your browser. In doing so however, you may no longer be able to access all or parts of the Web Portal. If you use multiple devices or browsers, you will need to reproduce the above process on each of them. You have a right of access to your Personal Data as processed by AGC AUTOMOTIVE EUROPE using the Web Portal. If you believe that any information on the Web Portal relating to you is incorrect, obsolete or incomplete, you may request the correction or update thereof. AGC AUTOMOTIVE EUROPE will promptly correct or update any such information. Alternatively, you can log in to your account page and adapt directly your information.
You have the right to request erasure of your Personal Data or restriction of processing concerning your Personal Data or to object, in whole or in part, to the processing of your Personal Data for direct marketing purposes or otherwise, under the conditions of the GDPR. [For Italy only: You also have the right to require from AGC AUTOMOTIVE EUROPE a certificate confirming the above.] You also have the right to data portability (i.e. the right to obtain the Personal Data you have provided to AGC AUTOMOTIVE EUROPE in a structured, commonly used and machine-readable format and to request the transmission of such Personal Data to a third party without hindrance from AGC AUTOMOTIVE EUROPE and subject to your confidentiality obligations).

When sending us such a scan, please make sure to hide your picture and personal identification number on the scan.].
If you are not satisfied with how AGC AUTOMOTIVE EUROPE processes your Personal Data, please let us know and we will investigate your concern. In any case, you have also the right to make a complaint to the competent data protection authorities, in addition to your other rights.
